Dispute Resolution and Limitation of Liability

1. Binding Arbitration: Any disputes arising from or related to the use of artletics.shop services shall be resolved through binding arbitration, conducted in accordance with the rules of the American Arbitration Association. By using our services, you waive your right to a trial by jury or to participate in a class action lawsuit.

2. Waiver of Class Actions: All claims must be brought on an individual basis, and you agree not to combine your claim with those of any other person or entity.

3. Limitation of Liability: artletics.shop, including its officers, directors, employees, and agents, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

    • (i) Your use or inability to use the service;
    • (ii) Any unauthorized access to or use of our servers and/or any personal information stored therein;
    • (iii) Any interruption or cessation of transmission to or from our services;
    • (iv) Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party;
    • (v) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages.

       

4.  Product Non-Delivery & Shipping Issues:

      • artletics.shop acts as a marketplace connecting buyers and artists. We do not directly handle the shipping of products. Any issues related to lost, delayed, or undelivered items must be resolved between the buyer and the artist or shipping carrier.
      • While we strive to facilitate a smooth transaction, artletics.shop is not liable for any lost, stolen, misdelivered, or damaged shipments. Any claims must be directed to the shipping carrier or the seller from whom the item was purchased.

5. Governing Law: These terms shall be governed by and construed in accordance with the laws of the state in which artletics.shop operates, without regard to its conflict of law principles.

6. Changes to This Clause: We reserve the right to update or modify this dispute resolution and limitation of liability clause at any time. Your continued use of the services after any such changes constitutes your acceptance of the new terms.
